Maryland DUI laws can be tough. Even a first offense as a drunk driver can lead to jail time. Since adopting the new .08 blood alcohol content standard in 2001, the Maryland state law divides drunk driving offenses into two categories:
DUI
Under Maryland DUI laws, if you have a blood alcohol content of .08 or above, you can be arrested for a DUI, or driving under the influence of alcohol. A first offense can result in up to a year in jail and a $1,000 fine. A second offense can result in two years in jail and a $2,000 fine. A third offense can lead to three years in jail and a $3,000 fine.
DWI
Maryland DUI laws have also established a second level of offense, driving while impaired, or driving while intoxicated. If you are arrested for driving with a blood alcohol content between .07 and .08 you could face 60 days in jail and a $500 penalty.
Drivers License Consequences
Getting arrested for a DUI or a DWI in Maryland not only means jail time and a fine, but could also have serious consequences for your drivers license. Under Maryland DUI laws a drunk driver convicted of a DUI with a .087 blood alcohol content could lose his or her license for 45 days and will lose 12 points off his or her license and may get that license revoked. Subsequent offenses can lead to bigger suspensions that can only be modified through an interlock device on your car so you can go to work, school or substance abuse classes. If you refuse a breath test, you could lose your license for 120 days.
